{"id":109934,"date":"2025-02-07T13:03:43","date_gmt":"2025-02-07T13:03:43","guid":{"rendered":"https:\/\/chezaspin.com\/blog\/index.php\/2025\/02\/07\/icc-condemns-us-sanctions-and-vows-to-continue-providing-justice\/"},"modified":"2025-02-07T13:03:43","modified_gmt":"2025-02-07T13:03:43","slug":"icc-condemns-us-sanctions-and-vows-to-continue-providing-justice","status":"publish","type":"post","link":"https:\/\/chezaspin.com\/blog\/icc-condemns-us-sanctions-and-vows-to-continue-providing-justice\/","title":{"rendered":"ICC condemns US sanctions and vows to continue \u2018providing justice\u2019"},"content":{"rendered":"<p>The International Criminal Court (ICC) has vowed to continue its judicial work after US President Donald Trump signed an order to impose sanctions on its staff.<\/p>\n<p>The ICC said it \u201cstands firmly\u201d by its personnel and the order seeks to harm its \u201cindependent and impartial\u201d work.<\/p>\n<p>Trump\u2019s order accuses it of \u201cillegitimate and baseless actions\u201d, after the ICC issued an arrest warrant for Netanyahu over alleged war crimes in Gaza, which Israel denies. The ICC also issued a warrant for a Hamas commander.<\/p>\n<p>The ICC is a global court, although the US and Israel are not members, with the power to bring prosecutions for genocide, crimes against humanity and war crimes.<\/p>\n<p>In its statement, it said: \u201cThe ICC condemns the issuance by the US of an executive order seeking to impose sanctions on its officials and harm its independent and impartial judicial work.<\/p>\n<p>\u201cThe Court stands firmly by its personnel and pledges to continue providing justice and hope to millions of innocent victims of atrocities across the world, in all situations before it,\u201d it added.<\/p>\n<p>In recent years, it has also issued arrest warrants for Russian President Vladimir Putin over alleged war crimes in Ukraine, Taliban leaders for \u201cpersecuting Afghan girls and women\u201d and Myanmar\u2019s military leader for crimes against the Rohingya Muslims.<\/p>\n<p>The US and Israel are not members of the court but more than 120 countries are, including the UK and many European nations.<\/p>\n<p>Trump signed the measure as Israeli Prime Minister Benjamin Netanyahu was visiting Washington.<\/p>\n<p>The sanctions place financial and visa restrictions on individuals and their families who assist in ICC investigations of American citizens or allies.<\/p>\n<p>Judges at the court said there were \u201creasonable grounds\u201d that Netanyahu, his former defence minister Yoav Gallant, and Mohammed Deif of Hamas bore \u201ccriminal responsibility for alleged war crimes and crimes against humanity.<\/p>\n<p>Deif\u2019s death in an Israeli airstrike last year has since been confirmed by Hamas.<\/p>\n<p>Reacting to Trump\u2019s order, Ursula von der Leyen, the European Commission president, said on <a target=\"_blank\" href=\"https:\/\/x.com\/vonderleyen\/status\/1887802247033045301\">X<\/a> that the ICC \u201cmust be able to freely pursue the fight against global impunity\u201d.<\/p>\n<p>\u201cEurope will always stand for justice and the respect of international law,\u201d she said.<\/p>\n<p>The Netherlands, which hosts the court, said it \u201cregrets\u201d Trump\u2019s order.<\/p>\n<p>\u201cThe court\u2019s work is essential in the fight against impunity,\u201d Dutch Foreign Minister Caspar Veldkamp said on X.<\/p>\n<p>A White House memo circulated on Thursday accused the Hague-based ICC of creating a \u201cshameful moral equivalency\u201d between Hamas and Israel by issuing the warrants at the same time.<\/p>\n<p>Trump\u2019s executive order said the ICC\u2019s recent actions \u201cset a dangerous precedent\u201d that endangered Americans by exposing them to \u201charassment, abuse and possible arrest\u201d.<\/p>\n<p>\u201cThis malign conduct in turn threatens to infringe upon the sovereignty of the United States and undermines the critical national security and foreign policy work of the United States government and our allies, including Israel,\u201d the order said.<\/p>\n<p>In a post on <a target=\"_blank\" href=\"https:\/\/x.com\/gidonsaar\/status\/1887763318909047124\">X<\/a> on Friday, Israel\u2019s Foreign Minister Gideon Saar said he \u201cstrongly\u201d commended Trump\u2019s executive order.<\/p>\n<p>He claimed the ICC\u2019s actions were \u201cimmoral and have no legal basis\u201d, accusing the court of not operating \u201cin accordance with international law\u201d.<\/p>\n<p>The US has repeatedly rejected any jurisdiction by the body over American officials or citizens, and has accused the ICC of placing constraints on Israel\u2019s right to self-defence, while ignoring Iran and anti-Israel groups.<\/p>\n<p>While the US is not a member of the ICC, the former clerk to the court\u2019s first chief prosecutor warned the sanctions could have \u201ca profound practical impact\u201d on its operations.<\/p>\n<p>\u201cThe sanctions\u2026 do have the potential of freezing property and assets, as well as suspending entry into the United States of ICC officials and their immediate family members,\u201d Zachary Kaufman told the BBC World Service.<\/p>\n<p>In his first term in office in 2020, Trump imposed sanctions on ICC officials who were investigating whether US forces had committed war crimes in Afghanistan.<\/p>\n<p>This included a travel ban and asset freezes against former chief prosecutor Fatou Bensouda.<\/p>\n<p>Those sanctions were lifted by President Joe Biden\u2019s administration.<\/p>\n<p>Last month, the US House of Representatives voted to sanction the ICC, but the bill foundered in the Senate.<\/p>\n<p>In response to efforts to what they described as attempts to challenge the ICC\u2019s authority, nine nations \u2013 including South Africa and Malaysia \u2013 launched the \u2018Hague Group\u2019 last month in an effort to defend the court and its rulings.<\/p>\n<p>Trump\u2019s executive order said that \u201cboth nations [the US and Israel] are thriving democracies with militaries that strictly adhere to the laws of war\u201d.<\/p>\n<p>During his last weeks in office, President Biden also criticised the ICC\u2019s warrant for Netanyahu, calling the move \u201coutrageous\u201d and saying there was no equivalence between Israel and Hamas.<\/p>\n<p>The ICC prosecutor\u2019s case against Netanyahu and Gallant found reasonable grounds to believe that they \u201ceach bear criminal responsibility for the following crimes as co-perpetrators for committing the acts jointly with others: the war crime of starvation as a method of warfare; and the crimes against humanity of murder, persecution, and other inhumane acts\u201d.<\/p>\n<p>It also found reasonable grounds to believe that \u201ceach bear criminal responsibility as civilian superiors for the war crime of intentionally directing an attack against the civilian population\u201d.<\/p>\n<p>Trump\u2019s signing of his latest executive order follows his announcement during a joint press conference with the Israeli prime minister on Tuesday about a plan for the US to \u201ctake over\u201d Gaza, resettle its Palestinian population and turn the territory into the \u201cRiviera of the Middle East\u201d.<\/p>\n<p>After Arab leaders and the UN condemned the idea, the US president restated it on his Truth Social social media platform on
