{"id":125131,"date":"2025-11-21T14:06:03","date_gmt":"2025-11-21T14:06:03","guid":{"rendered":"https:\/\/chezaspin.com\/blog\/index.php\/2025\/11\/21\/kindiki-decries-judicial-rulings-impeding-manifesto-implementation\/"},"modified":"2025-11-21T14:06:03","modified_gmt":"2025-11-21T14:06:03","slug":"kindiki-decries-judicial-rulings-impeding-manifesto-implementation","status":"publish","type":"post","link":"https:\/\/chezaspin.com\/blog\/kindiki-decries-judicial-rulings-impeding-manifesto-implementation\/","title":{"rendered":"Kindiki decries judicial rulings impeding manifesto implementation"},"content":{"rendered":"<p>NAIROBI, Kenya Nov 21 \u2013 Deputy President Kithure Kindiki has lamented the Judicial rulings that\u200b impede the implementation of Kenya Kwanza\u2019s manifesto and slowing\u200b down the economic development geared towards the citizens<\/p>\n<p>Speaking when he presided over the Launch of The State of Judiciary\u200b and Administration of Justice Report 2024\/2025\u200b, Kindiki cited the numerous rulings that have denied\u200b Kenyans developments even though it is enshrined in the \u200bConstitution.<\/p>\n<p>\u200b\u200b\u201dAnd there is no dispute on whether the judiciary is supposed to be independent. What we are looking for is clarity on where that independence meets with interdependence with other arms of government because at some point however extreme however pure that doctrine is, at some point it will intersect with interdependence.\u201d<\/p>\n<p>\u200b\u201dI have submitted before and I do submit here again that this independence brought and pure as it may be must only be restricted to four areas. Anything beyond those four legs, decisional independence, financial independence, administrative independence, and operational independence, you must submit to other arms of government and other agencies for a democracy to work\u200b,\u201d he started.<\/p>\n<p>The DP also challenged the Judiciary to avoid overstepping its mandate\u200b on the \u200bDoctrine of \u200bSeparation of \u200bPowers and the Independence \u200bof Judiciary\u200b.<\/p>\n<p>Kindiki reaffirmed the Kenya Kwanza\u2019s administration commitment\u200b in fast tracking the Judges retirement law before the end of this year\u200b that will give dignity to the court officers when they retire\u200b.<\/p>\n<p>\u200b\u200b\u201dOur country has done so well in providing a very robust interpretation of the \u200bBill of \u200bRights. But unfortunately until now we have concentrated on unbundling civil and political rights which are the first generation rights. Yet the constitution of Kenya places at the center of the \u200bBill of \u200bRights social economic rights.\u200b\u201d<\/p>\n<p>\u200b\u201dYou have \u200ba challenge\u200b, the \u200bJudiciary of Kenya\u200b, to interpret \u200bArticle 43 of the \u200bConstitution. It cannot be muted. You must tell us what those rights in \u200bArticle 43 mean for Kenyans.
