Obstruction can amount to a criminal offence<\/h3>\n<p>Under Section 46, it is an offence to:<\/p>\n<p>Leave a vehicle on the road in a dangerous position<\/p>\n<p>Create a hazard that endangers other road users<\/p>\n<p>Crucially, the law states that a person can be held liable for death caused not just by driving \u2014 but by obstruction.<\/p>\n<p>This means a stationary vehicle can legally be treated the same as reckless driving if it contributes to a fatal crash.<\/p>\n<h3 class=\"wp-block-heading\">2. General obstruction is also prohibited<\/h3>\n<p>Section 53 of the Act outlaws any obstruction of traffic, including:<\/p>\n<p>Vehicles left on highways<\/p>\n<p>Poorly positioned breakdowns<\/p>\n<p>Failure to remove or warn other motorists<\/p>\n<p>Even without fatalities, this can lead to prosecution and penalties.<\/p>\n<h2 class=\"wp-block-heading\">Why the Gilgil crash fits the legal threshold<\/h2>\n<p>Based on preliminary findings:<\/p>\n<p>The trailer was stationary on a live highway lane<\/p>\n<p>The crash happened at night, when visibility is reduced<\/p>\n<p>The matatu collided directly into its rear<\/p>\n<p>Investigators will likely examine:<\/p>\n<p>Was the trailer properly marked (hazard lights, reflectors, triangles)?<\/p>\n<p>Was it positioned safely off the road?<\/p>\n<p>How long had it been stationary?<\/p>\n<p>If negligence is established, the driver or owner of the trailer could face serious charges \u2014 including under Section 46.<\/p>\n<h2 class=\"wp-block-heading\">A wider pattern: deadly roadside hazards<\/h2>\n<p>The Gilgil crash is not isolated.<\/p>\n<p>Just days earlier:<\/p>\n<p>15 people died along the Nyeri\u2013Nyahururu road after a collision involving a matatu and a log truck<\/p>\n<p>Across the country, common contributing factors include stalled or slow-moving heavy vehicles, poor lighting and lack of reflectors, and inadequate warning to approaching motorists.<\/p>\n<h2 class=\"wp-block-heading\">Legal duty of drivers with stalled vehicles<\/h2>\n<p>The Traffic Act creates a clear duty of care.
