However, as of June 2026, just three cases have progressed to trial, while 46 remain at different stages of investigation.

According to the watchdog, three additional files have been forwarded to the Office of the Director of Public Prosecutions (ODPP) for review and direction. One case is undergoing internal legal review, four were closed after internal investigations, and five were terminated following recommendations from the ODPP.

The update highlights the slow pace of accountability in one of the deadliest episodes of police-civilian confrontation in recent Kenyan history, with many families of victims still awaiting justice.

IPOA attributed the delays to the complexity of investigations, noting that the authority relies heavily on external agencies, including the National Forensic Laboratory and the Government Chemist, for forensic examinations and ballistic analysis.

“The completion of investigations is often complex and requires extensive processes involving multiple external agencies,” IPOA said, adding that some cases have been hampered by insufficient evidence.

The authority emphasized that not every completed investigation automatically leads to prosecution, explaining that cases proceed to court only after evidence meets the legal threshold and receives approval from the ODPP.

“The three cases before court are those in which the evidence and prosecutorial thresholds have been met, enabling criminal proceedings to commence,” the statement said.

IPOA also provided updates on more recent protest-related fatalities.

The authority said it registered 27 death cases linked to the June 2025 Gen Z Memorial demonstrations. Of these, one case is already before the court, while 26 remain under active investigation.

Regarding the July 2025 Saba Saba protests, IPOA recorded 38 deaths. Two cases have since been closed internally, while investigations continue in the remaining 36 cases.

Human rights groups have repeatedly raised concerns over delays in investigations and prosecutions, arguing that prolonged timelines risk undermining public confidence in the justice system and denying closure to affected families.

NAIROBI, Kenya, Jun 22 – The Independent Policing Oversight Authority (IPOA) has revealed that only three cases arising from deaths during the 2024 Anti-Finance Bill protests have reached court, with the majority of investigations still unresolved nearly two years after the demonstrations that left dozens dead.
