The National Assembly has announced plans to challenge the High Court ruling that declared the National Government Constituencies Development Fund (NG-CDF) Act of 2015 unconstitutional.<\/p>\n
In a statement, the National Assembly indicated that its legal team intends to challenge all aspects of the court\u2019s finding delivered on Friday by Justices Kanyi Kimondo, Roselyn Aburili, and Mugure Thande.<\/p>\n
The court\u2019s decision stemmed from a 2016 petition filed by the Katiba Institute and other parties.<\/p>\n
The ruling stated that the NG-CDF violated the principles of public finance and the doctrine of separation of powers.<\/p>\n
The judges further argued that the fund interferes with the functions of devolved units, leading to duplication of activities and wastage of resources.<\/p>\n
However, the court granted a grace period of one year and eight months, set to expire on June 26, 2026, for the completion of all ongoing NG-CDF projects.<\/p>\n
The National Assembly also plans to request a stay of the court\u2019s declaration pending the outcome of the appeal in a bid to ensure that operations of the NG-CDF continue uninterrupted.<\/p>\n
