KAKAMEGA, Kenya, Mar 23 — A Small Claims Court in Kakamega has ordered the attachment of Mumias MP Peter Salasya’s Landcruiser over a Sh500,000 million debt.
Magistrate Caroline Cheruiyot ordered the police to facilitate an auctioneer in a ruling on Friday after a businessman who advanced the loan to the lawmaker cited frustration in reclaiming the funds.
Robert Lutta sued the MP on October 23, 2023, after Salasya reportedly refused to pay the sum in two months as agreed.
“Being a friend for so many years I accepted to advance him the amount on December 13 last year (2022),” he told the court.
“On the material day, I proceeded to the Kenya Commercial Bank (Mumias Branch) where I made a direct transfer of the Sh500,000 to the personal account of the MP who promised to refund the amount within two months from the date of the transaction,” he explained.
The magistrate ordered an auction after dismissing Salasya’s counterclaim of Sh1 million in a verdict rendered on November 27, 2023, after the lawmaker failed to present proof.
She had directed the lawmaker to pay the principal sum with interest.
In her orders on Friday, Cheruiyot directed Shianda OCS to secure the seizure of Salasya’s vehicle.
“I order that the Officer in Charge of Shianda (OCS) Police Station, or any nearest police station officer in the rank of OCS to provide adequate security to M/S Armok Auctioneers to proceed and attach the proclaimed property (Land Cruiser KDK037L),” she ordered.
The directive followed a successful search that ascertained the ownership of the vehicle in question.
A copy of the log book presented in court identified the car as a 4600cc engine, gold Landcruiser manufactured in 2016.
