NAIROBI, Kenya Feb 15 – Antony Kimamo Wachira, a Kenyan national, has been charged with indecently assaulting two minors aged between two and seven years in Texas, United States of America.
The prosecution informed Senior Principal Magistrate Benard Ochoi that the accused committed the offense on diverse dates between 2021 and June 2022 at an unknown location in Texas, USA.
Wachira has been under investigation since then and was released on a police cash bail of Sh200,000.
Prosecuting Counsel James Gachoka opposed the accused’s release on bond, citing concerns raised by the investigating officer in an affidavit indicating that Wachira is a flight risk.
Although the affidavit had not been commissioned, Gachoka urged the court to detain the accused pending further proceedings.
However, Wachira’s lawyer, John Swaka, argued that his client would not flee the court’s jurisdiction if granted bond or bail.
After considering the arguments, the court ruled that the Sh200,000 deposited with the police be transferred to the court and scheduled the matter for mention on February 20, 2024, for further directions.
